Privacy & text messaging

Elusive Remodel ("we") runs this website to take project requests from homeowners and to coordinate work with licensed contractors in South Florida. This page explains what we collect and what we do with it.

We serve homeowners in Florida (Miami-Dade, Broward and Palm Beach counties, Orlando, Tampa and Destin) and in Louisville, Kentucky. This policy applies to our website, chat, project forms, phone calls, text messages and emails. By using them, you acknowledge the practices described here.

What we collect

• From homeowners: name, mobile number, email, property address, project details, photos you choose to upload, and messages you send us.
• From contractors: company name, contact name, phone, email, licence number, trades, service areas and business details.
• Automatically: technical information such as your IP address, browser and device type, the pages you visit and how you reached our site (for example, the website, ad or campaign that referred you).
• Stored in your browser: our site saves the source of your visit for up to 30 days, and your chat conversation, in your browser's local storage so they are available if you send a request or come back to the chat. You can clear this at any time in your browser settings.

Please do not send us sensitive information such as Social Security numbers, bank or card numbers, health information or passwords through the website, chat, text or email. Please make sure photos you upload show only the areas of your home relevant to your project and do not include people or personal documents. You are responsible for making sure the information you give us is accurate and that you have the right to share it, including information about other people at the property.

How we use it

• To respond to your request, arrange a site visit and prepare a proposal.
• To assign your project to a contractor and keep you updated on its progress.
• To review contractor applications and offer approved contractors suitable work.
• To contact you by phone, text or email about your request, as you agreed when you submitted it.
• To operate, secure and improve our website and services, and to measure how well our website and advertising work.
• To prevent fraud and abuse, keep business records, comply with the law and licensing requirements, handle warranty claims, and establish, exercise or defend legal claims.

We may also create de-identified or aggregated information that does not identify you and use it for any lawful purpose.

Who we share it with

When a contractor accepts your project, we share your name, phone number, property address and project details with that contractor so they can do the work. Contractors who are offered a job but have not accepted it see only the type of work, the city and the visit time. We do not sell your information.

If you ask for an AI style preview on our project form, the photo you pick is sent to OpenAI to create the preview image. We keep the preview for two hours, or with your request if you send one. OpenAI processes the photo under its own data policies. AI previews are illustrations only. They are not a design, quote or promise of the finished work.

If you use the chat on our site, we keep the conversation and the contact details you give so our team can reply. If you leave the site before we answer, we send the reply by text (only if you ticked the box) or by email.

We use service providers to host the site and our records, send email and text messages, and provide address suggestions and analytics. We give them only the information they need to provide their services. Our project form uses Google Maps to suggest addresses as you type, so the address you enter is sent to Google for that purpose under Google's privacy policy.

Analytics and advertising. Our site uses Google Analytics and Google Ads, which use cookies and similar technologies to tell us how visitors use the site and whether our ads lead to project requests. Google may use this information to show our ads to people who have visited our site, which some state laws call "targeted advertising." You can opt out through Google's ad settings or the Google Analytics opt-out add-on, or by contacting us.

We may also disclose information to our lawyers, accountants and insurers; when we believe it is required by law, subpoena or court order; to protect the rights, property or safety of Elusive Remodel, our customers or others; to collect amounts owed; and in connection with a merger, financing, sale or transfer of all or part of our business.

Our website links to other websites and services, such as social media and financing providers. We are not responsible for their content or privacy practices. Please review their policies before giving them information.

Text messaging terms

• By submitting a request and ticking the consent box, you agree to receive text messages from Elusive Remodel about that request, such as confirmations, appointment reminders and project updates. If you ticked the box in our chat, you agree to receive our chat replies by text.
• Texts may be sent using automated technology. Your consent remains in effect until you opt out.
• Message frequency varies with your project. Message and data rates may apply.
• Reply STOP to stop receiving texts. Reply HELP for help, or call 305-433-3225.
• You can also opt out by replying with words such as "quit," "cancel" or "unsubscribe," or by contacting us at 305-433-3225 or sales@elusiveremodel.com. We may send one text confirming your opt-out, and we will honor your request within 10 business days.
• Consent to receive texts is not a condition of any purchase.
• By giving us a mobile number, you confirm that you are the account holder or regular user of that number and are allowed to agree to receive texts at it. If you give up or change your number, please tell us so we do not text the new user.
• We will ask for your separate consent before sending you promotional texts.
• Mobile carriers are not liable for delayed or undelivered messages. We may change or end our text messaging program at any time.
• We do not share your mobile number or text messaging consent with third parties for their marketing purposes.

Emails

We email you about your request, such as confirmations, appointment details and project updates. Any promotional email we send will include an unsubscribe link, and we process unsubscribe requests within 10 business days. Unsubscribing from promotional emails does not stop emails about your project. We do not share your email address with third parties for their marketing purposes.

How long we keep it

We keep project and contractor records for as long as needed to complete the work, handle warranty questions and meet legal and tax obligations, then delete or anonymise them.

We may keep information longer when the law requires or allows it, or when it is needed to resolve disputes, enforce our agreements or defend legal claims. When we dispose of records, we do so securely.

How we protect it

We use reasonable administrative, technical and physical safeguards to protect your information from unauthorized access, use or disclosure. No website, transmission over the internet, email or text message is completely secure, so we cannot guarantee the security of information you send us. If a security breach affects your personal information, we will notify you as required by applicable law, including Florida and Kentucky law.

Your choices and privacy rights

You can ask us to access, correct or delete your information by emailing sales@elusiveremodel.com or calling 305-433-3225.

Depending on where you live, including Kentucky under the Kentucky Consumer Data Protection Act, you may also have the right to:

• confirm whether we process your personal data and get a copy of it, in a portable format where technically feasible;
• correct inaccurate personal data;
• delete personal data you gave us or that we hold about you; and
• opt out of targeted advertising, the sale of personal data, and profiling that produces legal or similarly significant effects. We do not sell personal data or use it for that kind of profiling.

To protect your information, we will verify your identity before acting on a request, usually by contacting you at the phone number or email we have on file. We may decline a request when we cannot verify it, or when an exception in the law applies, for example records we must keep for legal, tax, licensing or warranty reasons, or information needed to complete a contract with you or to defend legal claims. We will not discriminate against you for exercising your rights.

We respond within 45 days, and may extend that by up to 45 more days when reasonably necessary, in which case we will tell you. Responses are free for up to two requests in a 12-month period. For requests that are clearly unfounded, excessive or repetitive, we may charge a reasonable fee or decline, as the law allows.

If we decline your request, you may appeal by emailing sales@elusiveremodel.com with "Privacy appeal" in the subject line. We will respond in writing within 60 days. If we deny your appeal, Kentucky residents may contact the Kentucky Attorney General.

Children

Our website and services are meant for adults. We do not knowingly collect personal information from children under 13. If we learn that we have, we will delete it.

Changes to this policy

We may update this policy from time to time. Changes take effect when posted, and the date at the top shows the latest version. If we make a material change to how we use personal information we already hold, we will give you notice and, where the law requires it, ask for your consent.
